Prosecutor: Boy planned shooting of neo-Nazi dad

RIVERSIDE, Calif. (AP) ? The 10-year-old son of a neo-Nazi leader told his younger sister that he planned to shoot their father, then a day later took a gun from his parents' bedroom and fired one bullet into his father's head as he slept on a couch, a prosecutor alleged Tuesday.

The boy's father, Jeff Hall, was an out-of-work plumber who as regional leader of the National Socialist Movement headed rallies at a synagogue and a day labor site.

In opening statements at the murder trial, Riverside County prosecutor Michael Soccio dismissed the notion that Hall's neo-Nazi beliefs contributed to his son's behavior, as the defense maintains, and instead said the boy, now 12, was a violent child who had been kicked out of every school he attended.

The boy also suspected his father was going to leave his stepmother, and he didn't want the family to split up, prosecutors have said.

"You'll learn that (the child) would have shot his father even if he'd been a member of the Peace and Freedom Party. It made no difference," Soccio said, before showing the court photos of Hall playing tea party with his young children. "They lived a relatively normal life."

The Associated Press is not identifying the child because he is a juvenile.

The boy with light brown hair sat quietly in court next to his attorney and wore a purple polo shirt and glasses. He showed little emotion when the prosecution flashed photos through a projector of his blood-spattered father, and he appeared to be taking notes in a spiral-bound notebook.

On several occasions, he asked his attorney how to spell the name of a witness taking the stand.

Defense attorney Matthew Hardy countered in his opening statement that his client had grown up in an abusive and violent environment and was conditioned to believe it was right to kill people who were a threat.

Hall taught his son to shoot guns, took him to neo-Nazi rallies and once to the Mexican border to teach him how to "make sure he knew what to do to protect this place from the Mexicans," Hardy said.

"If you were going to create a monster, if you were going to create a killer, what would you do?" he said. "You'd put him in a house where there's domestic violence, child abuse, racism."

Hardy also claimed the boy's stepmother Krista McCary, who is expected to testify, goaded the boy into killing Hall because Hall was planning to leave her for another woman. Hall sent her text messages on the night he was shot saying he would divorce her, Hardy said.

McCary sat in on the child's interviews with police and psychiatrists after the shooting, he said, and she lied to investigators.

The boy saw an opportunity when his father came home from a party but was locked out and had to get in the house by crawling through a window, Soccio said.

Hall fell asleep on the couch, and the boy got a gun from his parent's room and shot Hall at near point-blank range behind his left ear, the prosecutor said.

"He held the gun about a foot away and, as he explained, he took four fingers and put them into the trigger and pulled the trigger back and the gun discharged," Soccio said, showing images of a bloodied Hall on the couch covered by a blue blanket.

Several police officers testified that the boy and at least one of his siblings voluntarily gave statements immediately after the shooting that indicated the boy had killed his father.

One younger sister asked the boy why he hadn't shot their father in the stomach, as he said he planned to do, according to Officer Robert Monreal, who picked up the exchange on a belt recorder.

Prosecutors previously said the two siblings talked about the shooting as they played on a swing set a day before the attack.

Another officer testified that the boy was held in a patrol car at the scene and began to talk almost non-stop from the backseat. Officer Michael Foster said the child acknowledged shooting his father and began to show remorse.

"He was sad about it. He wished he hadn't done it," Foster recalled. "He asked me about things like, do people get more than one life, things like that. He wanted to know if he was dead or if he just had injuries."

The boy has a history of being expelled from school for violence, starting at age 5 when he stabbed a teacher with a pencil on the first day of kindergarten, Soccio said outside court. He also tried to strangle a teacher with a telephone cord a few years later, he said.

Hall, 32, who said he believed in a white breakaway nation, ran for a seat on the local water board in 2010 in a move that disturbed many residents in the recession-battered suburbs southeast of Los Angeles. The day before his death, he held a meeting of the neo-Nazi group at his home.

The boy's stepmother told authorities that Hall had hit, kicked and yelled at his son for being too loud or getting in the way. Hall and the boy's biological mother had previously slugged through a divorce and custody dispute in which each had accused the other of child abuse.

Kathleen M. Heide, a professor at the University of South Florida in Tampa who wrote "Why Kids Kill Parents," said children 10 and under rarely kill their parents and that only 16 such cases were documented between 1996 and 2007.

Heide also said parenting and home life would undoubtedly play a role in the development of the boy.

If a judge finds the boy murdered Hall, he could be held in state custody until he is 23 years old.

The state currently houses fewer than 900 juveniles.

Broadway takes few chances with superstorm coming

(AP) ? Broadway took the threat of the mammoth storm seriously, with theater owners canceling all Sunday evening and Monday performances of shows like "The Book of Mormon" ''Once" and "Mama Mia!" long before a drop of rain fell in Times Square.

"The safety and security of theatregoers and employees is everyone's primary concern," said Charlotte St. Martin, executive director of The Broadway League, which represents producers.

Forecasts called for rain late Sunday or early Monday, and subway and public transportation service is to be halted Sunday evening, potentially stranding theatergoers. Refunds will be made available from the point of purchase.

Off-Broadway shows including "Stomp," ''Bad Jews" and "Golden Child" were also canceled Sunday night. Most matinees on and off Broadway stayed open. Mondays are usually very light on Broadway, with most shows having that as their day off.

Some Broadway shows had no evening shows scheduled Sunday, including "Cyrano de Bergerac," ''Annie," ''Chaplin," ''Enemy of the People," ''Once," ''Jersey Boys" and "Nice Work If You Can Get It."

It was the most disruptive storm for the theater community since the threat of Hurricane Irene in late August 2011 prompted producers to cancel matinee and evening performances on Saturday and Sunday. While that hurricane mostly fizzled over New York, every show lost money because they were mostly limited to five or six performances that week.

Upgrades Needed But Money Is Tight - Computers, Math, Science ...

Down to business - windows XP doesn't mean it's a weak computer - the processor, RAM, video card and hard drive will (especially if the drive is clogged full.

If you have no idea what your PC's specs are, hit the START button, choose RUN and type "DXDIAG"

Let me know what processor you have, how much RAM and the next page should show you what video card you have - share that too if you can.

If your desktop is some sort of name-brand thing, it might have a model number easily visible - that might also help me look up what your specs are.

When I know what you have, I'll tell you what upgrades are cheapest + best. If not, I'll suggest the least expensive upgrades possible for you...

With a budget of even a 200-300, I can tell you what'll perform best!

More businesses are saving more thanks to the Scottish Government?s Small Business Bonus Scheme (SBBS), according to official statistics published today.

The figures show that 89,087 properties are benefitting from SBBS in 2012 -13 an increase of almost 4,000 from this time last year. In 2012-13 ?144 million in business rates relief was provided, an increase of ?13 million from 2011-12 when ?131 million of relief was provided.

The maximum saving per property in 2012-13 is ?4,500 and a total of ?564 million of relief has been awarded to Scottish businesses since the introduction of the scheme.

Local Government Minister Derek Mackay said:

"I am extremely pleased to learn that so many of our smaller companies are taking advantage of the Small Business Bonus Scheme. The substantial savings that they are making on their rates bills can help give them the competitive edge that is so important in the current economic climate.

"The success of our small and medium sized businesses is essential to the success of our overall economy. That is why the Scottish Government is committed to maintaining Scotland as the most competitive place to do business and providing the most generous package of reliefs, which includes the SBBS, available anywhere in the UK. When considered together these reliefs are worth over ?500 million a year.

"We have already agreed to maintain SBBS for the life of this Parliament - a clear indication of this Government?s commitment to take forward the policies that will help our businesses prosper.

"This is great news for the many tens of thousands of businesses in town centres the length and breadth of Scotland who are paying zero or substantially reduced rates under the SBBS"

This Android Phone is Tailor-Made for Visually Impaired People [VIDEO]

Rather than downloading various apps and software to accommodate their needs, the visually impaired are getting an Android smartphone developed specifically for them.

Telecom-product manufacturer Qualcomm and Project Ray are partnering to create one do-it-all device for visually impaired consumers. The off-the-shelf Android device will be able to read your messages, navigation and audio books aloud. It also has object recognition and will adapt to users? preferences and usage patterns. Users will navigate the touchscreen phone using vibration and sound.

This phone will reach an entirely under-served market when it comes to smartphones. There are 285 million visually impaired people in the world, 39 million of which are blind. Currently, several smartphone apps help visually impaired people identify paper currency, navigate streets and read text messages out loud. These options might be preferable to some visually impaired people who are strictly iPhone users, as Qualcomm and Project Ray?s phone is Android-based.

In recent times, technology has proven to help thevisually impaired. This May, a woman in Australia received a bionic eye implant. When the implant was turned on, she was able to see shapes and lights, after being blind for 30 years. Gasoline price declines in California pick up speed

The decline in California gasoline prices has accelerated in recent days, fuel surveys show, but hardly amounts to the relief from record fuel costs that most motorists would like to see.

The state average reached $4.432 for a gallon of self-serve regular gasoline, the Energy Department said Monday. That was a decline of 19.1 cents in one week, according to the agency's survey of service stations. The week before, the average slipped less than 4 cents a gallon after reaching a record $4.659.

A separate survey by AAA found a similar pattern, placing the state's average pump price at $4.427 a gallon, down 18.2 cents from a week earlier. The week before, the average declined about 6 cents. On its way up to a record average of $4.671 a gallon Oct. 9, the state's gasoline prices jumped 17.1 cents in just one night.

"Prices are down some, but they are still a lot higher than they were last year, and the 2011 prices were already a record for this time of year," said Marie Montgomery, a spokeswoman for the Automobile Club of Southern California.

San Fernando resident Bart Reed said he just spent $75 to fill his car's gas tank, up from $60 before the price surge.

"That doesn't feel like relief," said Reed, who runs a nonprofit advocacy group called the Transit Coalition.

The California Energy Commission said that the price surge was due in part to a power outage that shut down Exxon Mobil's Torrance refinery at a time when the state was near five-year lows in refinery production and fuel supplies.

Barring another refinery problem, analysts are predicting steady price declines.

"My forecast calls for gasoline prices in Los Angeles/Long Beach to slowly decrease between now and Thanksgiving about $1 per gallon, to $3.60 per gallon," independent fuel price specialist Bob van der Valk said.

Meanwhile, there were rumors that another big player in the California refinery market might be looking to exit the state. The Wall Street Journal reported late Friday that Valero Energy Corp. was looking to sell at least two of the refineries it operates in California.

The San Antonio company has a 132,000-barrel-a-day refinery in Benicia, Calif., and a 78,000-barrel-a-day refinery in Wilmington. Both of those facilities produce gasoline and diesel for the California market.

Fadel Gheit, senior energy analyst for Oppenheimer & Co., said Valero might be looking for buyers because of a looming regulatory requirement in California that will mandate that refinery emissions match 1990 levels by 2020.

But a Valero spokesman said the company hasn't said anything about the possibility of selling since 2011, when company officials said they were considering their options on what to do with the refineries.

"Basically, it's just rumors, and it's our policy not to discuss unsubstantiated media accounts," spokesman Bill Day said. The 2020 regulations, Day added, "will be very costly to our business and to California consumers."

Valero also owns a small refinery in Wilmington that produces asphalt.

Valero shares closed Monday at $29.47, down 6 cents.

In August, BP announced its intention to sell its Carson refinery and other some other California assets to Tesoro Corp. for $2.5 billion.

(AP) ? Election Day could well determine how much you end up paying in taxes. It could move the bar for fighting future wars. On energy, it could shape the balance between drill-baby-drill (and mine-baby-mine) and some big pollution controls. If you care about Obamacare, this may be your last, best chance to save it or unravel it ? with your vote.

Long after the fuss fades over President Barack Obama's snoozy debate opener and Mitt Romney's weird flub or two, one of them will be hard at work trying to make good on his agenda. This will include pressing any opportunity to reshape the Supreme Court, which hovers over all other issues.

The winner's policies are almost certain to find you where you live, no matter how far you are from Washington in your mind or your place. The taxman cometh. So does the Social Security check for retirees ? and the shakier-by-the-decade promise of those checks for everyone else.

Obama's mandate for almost everyone to have health insurance ? along with all the coverage protections that flow from that ? constitutes the largest reshaping of social policy in generations, with the effects to be felt ever more as the law takes firmer hold in the next few years. If Romney wins and gets enough like-minded people in Congress, he would reset that and try something else.

Though farther from home, the outsourcing of production overseas goes to the heart of American communities large and small as factory jobs vanish, or in some cases come back. Seemingly esoteric subjects like the value of China's currency and the fine print of trade deals affect what you pay for goods and perhaps whether you or the neighbors have work. Less obviously, the debt crisis on a faraway continent affects credit in the U.S. What happens in Greece, Spain and beyond may put your home loan out of reach if the turmoil gets out of hand.

Romney and Obama have sharp differences on these subjects and more, though they don't always make them easy to see. Much of the final leg of the campaign is about reaching for the middle ground. So nothing too radical, please.

For Romney, that means suddenly talking about his interest in seeing Pell grants rise for low-income college students, not about the major changes in government programs that would be required for him even to get close to his deficit-cutting goals.

For Obama, it means preaching fiscal discipline and an aggressive stance on energy production, not focusing on the tax increases for higher-end insurance policies in his health care law or the mercury pollution controls that could shut dozens of coal-fired power plants across the country. Although Obama failed to persuade a Democratic Congress to pass limits he promised on carbon emissions and he shelved a plan to toughen health standards on lung-damaging smog, a second term could give a second wind to steps like these.

Both candidates talk about cutting unnecessary regulation, but Romney's view of what's unnecessary is far more expansive than the Democrat's. That's part of a larger, fundamental and familiar divide between the two parties on the proper responsibilities of government.

Voters, like candidates, can't predict what economic calamity will come out of the blue. But it's clear both from records and rhetoric that Obama believes in the power of government and the Treasury to stimulate growth, add jobs and even save industries in ways that Romney doesn't. On Nov. 6, voters choose governing principles as much as a list of positions.

That holds true on foreign policy, too. At the moment, Romney comes across as more aggressive against Iran and on the conflict in Syria. On Afghanistan, he now supports the president's plan to end U.S. combat in 2014 and appears to have dropped his qualification that a withdrawal will depend on conditions on the ground at the time. Apparently modest differences may come to nothing after the campaign, or they could prove substantive ? determining whether the U.S. truly extricates itself from one war and how willing it will be to fight another.

The choice in the election doesn't just matter on the issues the candidates want to talk about. It can matter just as much on the issues they avoid. This is where the Supreme Court comes in.

With four justices in their 70s, there's a strong chance the next president will have a chance to fill at least one seat on a court closely divided between conservatives and liberals. One new face on the bench could mean a major change in civil liberties, gay relationships, gun control, health care, the approach to terrorism, perhaps access to abortion, and more, for years to come.

All told, a lot of tipping points on Election Day. That's democracy for you.

Caterpillar sees weak economy as it cuts outlook

MINNEAPOLIS (AP) ? Caterpillar says the world's economy is weaker than it thought, and it doesn't expect growth to pick up until the second half of next year.

The company on Monday cut its 2012 revenue and profit guidance, and took a very cautious view toward its performance in 2013.

Caterpillar makes the yellow-painted excavators, heavy tractors, and other construction equipment often seen on road-building projects. It's the world's largest maker of construction and mining equipment, and also makes engines. Its results are watched closely for signs of where the broader economy is headed.

Where it's headed right now is for some weak growth, based on what Caterpillar was saying on Monday.

It predicted worldwide economic growth of 2.7 percent for next year, up from the 2.5 percent growth it expects for 2012. It expects the cheap lending offered in most countries to continue next year, although "growth has been slow to respond," the company said.

"As a result, we are not expecting improvement in overall economic growth until the second half of 2013," the company said.

Caterpillar sells to dealers, who turn around and sell to end users like construction and mining companies. Those dealers are trying to cut inventory, so they're ordering less equipment than customers are buying.

In response, Caterpillar said it has reduced production, resulting in temporary shutdowns and layoffs. Lower production will continue until dealer demand lines up with end user demand, Caterpillar said.

The layoffs will generally be short-term, such as a factory shutting down for a week, the company's chief financial officer, Ed Rapp, said in an interview.

"We haven't seen the broad-based economic growth that we really anticipated in 2012," he said.

As a result, Caterpillar cut its 2012 outlook for the second time this year. Revenue is expected to grow 9.7 percent to $66 billion, after rising 41 percent in 2011. Profit is now forecast at $9 to $9.25 per share, down from a previous forecast of $9.60 per share.

Analysts surveyed by FactSet had expected revenue of $67.2 billion, with profit of $9.41 per share.

The company said growth was below expectations in the U.S. and China, and with much of Europe in recession.

The U.S., China and most developing economics should see modest improvement next year, Caterpillar said. But it sees "continuing difficulty" and only marginal growth in Europe.

"We're not expecting rapid growth, and we're not predicting a global recession," Chairman and CEO Doug Oberhelman said.

On Friday, General Electric Co. CEO Jeffrey Immelt said he's expecting economic conditions next year to be similar to this year. Most regions should show some improvement, but Europe's "going to be a grind," he said. Investors should get another view of the global economy from a major manufacturer when 3M Co. reports earnings on Tuesday.

Caterpillar expects 2013 revenue to be about the same as this year, plus or minus 5 percent.

The company said sales of mining gear will fall next year. Lower prices for metals and coal, along with higher operating costs, have hurt profit margins at many mining companies, Caterpillar said. Sales of construction gear are expected to increase, and it expects improving activity in the U.S. It expects engine sales to be flat.

Profit in the third quarter rose 49 percent to almost $1.7 billion, or $2.54 per share. That compares with profit of $1.14 billion, or $1.71 per share, a year earlier. Revenue rose 4.6 percent to $16.45 billion.

The results included a gain of $273 million, or 27 cents per share, from selling a majority interest in a logistics business. Analysts surveyed by FactSet had been expecting a profit of $2.21 per share, on revenue of $16.64 billion.

Shares of Peoria, Ill.-based Caterpillar Inc. rose $1.22 to close at $85.08 Monday.

On February 21, 2011, the St. Cloud Hospital notified the Minnesota Department of Health (MDH) of a cluster of unusual bacterial blood infections (including Ochrobactrum anthropi and Klebsiella oxytoca) among patients. Epidemiologists identified 25 patients that had unusual bacteria in their blood. A common factor was that the affected patients were all in the same post-surgical ward and all had received IV-pain-killing narcotics. On March 8, the St. Cloud Hospital informed MDH that a health care worker had admitted to diverting narcotics.

Among the 25 patients who had blood infections, six required intensive care, three had unplanned surgeries and one died within 2 days of their blood infection occurring. Some of the adverse consequences in these patients may be linked to inadequate pain management resulting from the diversion.

This situation and multiple other instances of health care worker drug diversion elsewhere in the country illustrate how serious drug diversion by health care workers can be and the significant impact it can have on patients.
